Article 5 – Computer and Freedom Law – Access Right, modifications, delete

 

Mr. Stéphane KERRIEN is responsible for data processing, as the manager of the one-shareholder Limited Liability company iHealthLabs Europe, registered at the Paris Trade and Companies register (Registre du Commerce et des Sociétés de Paris) under number B 792 514 341 and which headquarters are located 3 rue Tronchet, F-75008 Paris.

 

Pursuant to Article 22 of the  “Computers and Freedom” Law of July 6, 1978 as modified by the Law of August 6, 2004, the automated personal data processing have been declared to theFrench National Commission for Information Technology and Civil Liberties (CNIL).

 

In accordance with simplified standard 48 (Deliberation n° 2012-209 of June 21st, 2012), iHealth benefits from the simplified declaration procedure for any automated processing related to customers and prospects management. iHealth has declared the User’s Personal Data processing implemented on the Website to theFrench National Commission for Information Technology and Civil Liberties (CNIL) under number 1820891.

 

The Personal Data and Confidentiality Policy implemented by iHealth is constantly accessible by the User on the Website, in particular when modified or updated.

 

It shall be stated that iHealth develops and offers products, solutions and applications to its customers who followed the procedures implemented for this purpose, allowing them to purchase connected objects which may, under certain conditions, lead to the collection, confidential processing and safe hosting of some of the user’s personal health data. All the information related to this specific data, and regarding in particular the safety procedures and measures implemented by iHealth on secure servers and approved by the French governmental authorities, notably by the ASIP Santé services (French Digital Health Agency), is accessible on the concerned products, solutions and applications data sheets, in the section dedicated to them on the Website.

 

Pursuant to the “Computers and Freedom” Law of July 6, 1978 as modified by the Law of August 6, 2004, the User has a general right to access, amend, rectify and delete, in the event of legitimate reason, the Personal Data related to him/her, which might be collected thanks to cookies under the conditions defined below.

 

The User can exercise his rights and prerogatives by sending an email to the following address : support@ihealthlabs.eu or by sending a mail to iHealthLabs Europe, 3 rue Tronchet, 75008 Paris, including his/her last name, first name, email address and, if possible, his/her client reference number.

 

An answer will be then sent to the User with a maximum period of two (2) months following the reception of the request.

 

iHealth invites the User to get acquainted with its Personal Data and Confidentiality Policy accessible via the previous link.

 

 

Article 6 – Cookie Policy


The User shall be informed that, when visiting the Website, a cookie may be automatically installed on his/her browsing software. A Cookie is an element that does not allow the identification of a User but allows to record pieces of information related to the user’s browsing activity through the Website. You have the possibility to configure your web browser in order to be informed of the use of Cookies and, potentially, to refuse the use of cookies in accordance with the procedure described on the following website: www.cnil.fr

The information is retained by iHealth in the User’s computer for a maximum retention period of thirteen (13) months.

The Website  www.ihealthlabs.euand all its elements such as, in particular, the domain names, any trademark, logo, software, arborescence, database, graphic charter, designs and patterns, illustrations, animations, images, texts, are protected by intellectual property rights.

 

iHealth is the exclusive owner of the intellectual property rights related to the Website and all its elements, apart from photographs, videos and other media coming from the service providers themselves. Any copy, reproduction, representation, adaptation, alteration, modification, unauthorized disclosure, full or partial, extraction or reuse, repeated or systematic, including for private purpose, of all or part of the Website, by any means whatsoever, constitutes an infringement. 

 

The trademarks and domain names as well as the designs and patterns appearing on the Website are the exclusive property of iHealth.

 

No license or any other right than the right to visit the Website is granted to anyone with regard to intellectual property right. The reproduction of documents appearing on the Website is only authorized for the exclusive purpose of information for strictly personal and private use. Any reproduction and any use of copies made for other purposes are expressly prohibited.

Article 9- Disputes

 

The Legal Notices are established in accordance with the French Law, and in particular with the provisions oflaw 2004-575 of June 21, 2004 regarding Confidence in the Digital Economy (LCEN) as well as with “Computers and Freedom” Law of July 6, 1978 as modified by the Law of August 6, 2004.

 

Any dispute that might arise because of the acceptation, the validity, the interpretation, the application or the execution of any of the provisions referred to in Legal Notices herein, and that could not be settled amicably between the parties, will be taken, by express agreement, to  the competent authority at the Court of Appeal in Paris, which are the only ones to be competent, notwithstanding the place of subscription, the plurality of defendants, or guarantee call.
